Terms and Conditions

1. General Conditions

By booking a tour with Algarve Adv Trails, you agree to comply with the following Terms and Conditions. These terms are binding for all participants. Algarve Adv Trails reserves the right to update these Terms and Conditions at any time without prior notice.

2. Requirements for Participation

All participants in our tours must meet the following mandatory requirements:

· Driver’s License: A valid A2 or A driver’s license is required for anyone intending to drive our motorcycles.

· Documents: Participants must provide a valid Passport or ID at the start of the tour.

· Travel Insurance: Participants must have travel insurance that covers off-road driving and motor sports activities and bring documents to prove it. Algarve Adv Trails will not be held responsible for any accidents, injuries, or damages sustained during the tour, except where such liability cannot be excluded under applicable law.

3. Payments and Deposits

To confirm your booking, a non-refundable deposit of 50% of the total cost must be made in advance. The remaining balance is due upon 10 days before the tour.

Payment methods:

· Bank Transfer: Preferred method of payment for both deposits and payments. Bank details will be provided upon booking.

· Credit Card: Accepted with an additional 3% processing fee. If you choose to pay via these methods, the extra fee will be added to the total amount.

Failure to complete the payment in full prior to the tour’s start will result in cancellation, and the deposit will not be refunded.

4. Safety Deposit

A safety deposit is required from each participant before the tour or rental. This deposit is held as a precaution to cover any damages made to the equipment (motorcycles or accessories). The safety deposit will be returned in full up to 5 days after the tour ends, provided no damages are incurred.

· If the safety deposit is made via credit card instead of bank transfer, an extra 3% fee will be charged due to processing fees. This 3% fee is non-refundable and will not be returned with the safety deposit.

· The deposit amount must be paid up to 10 days before the tour.

· The safety deposit refund might take up to 5 days after the tour ends.

5. Cancellations and Refunds

· Cancellations by the Participant: Cancellations must be made in writing (email) and will result in the following refund conditions:

o Cancellations made more than 5 days prior to the tour date will be eligible for a 50% refund.

o Cancellations made less than 5 days prior to the tour date will not be eligible for a refund.

· Cancellations by Algarve Adv Trails: In case of unforeseen circumstances (e.g., severe weather, mechanical issues), Algarve Adv Trails reserves the right to cancel or postpone a tour. In such cases, participants will be offered a rescheduled date or a full refund.

6. Tour Modifications

Algarve Adv Trails reserves the right to modify the tour itinerary in the event of adverse weather conditions, trail conditions, or other factors that may affect safety or enjoyment. We will always aim to provide an alternative route or activity of equal value.

7. Equipment and Vehicles

Algarve Adv Trails provides vehicles (motorcycles) in excellent working condition for the duration of the tour. Participants must agree to:

· Proper Use: Follow all instructions from the guide regarding the use of vehicles and safety protocols.

· Damage to Equipment: Any damage caused to the vehicle or equipment will be the participant's responsibility, and the cost of repairs will be charged accordingly.

8. Safety and Conduct

Safety is a priority at Algarve Adv Trails. All participants are required to:

· Always follow the guide’s instructions during the tour.

· Wear appropriate safety gear (helmet, gloves, etc.), which will be provided or may be brought by the participant.

· Respect local traffic laws, as well as the environment and local communities while on tour.

· Do not drive under the influence of alcohol or drugs.

Algarve Adv Trails reserves the right to terminate a participant's involvement if they are found to be endangering themselves, others, or the integrity of the tour. No refund will be provided in such cases.

9. Liability Waiver

By participating in any Algarve Adv Trails activity, you acknowledge and accept the risks associated with off-road driving and motor sports activities. Algarve Adv Trails is not responsible for any accidents, injuries, or damages incurred during the tour or rental. It is the participant’s responsibility to ensure their travel insurance covers off-road driving and any potential medical costs that may arise from such activities.

10. Health and Fitness Requirements

Participants must ensure that they are in good health and physically fit to participate in off-road tours. If you have any medical conditions that could affect your ability to participate safely, please inform Algarve Adv Trails in advance. The company reserves the right to refuse participation if a person is deemed unfit to participate.

11. Photography and Media Use

During the tour, Algarve Adv Trails may take photos or videos of the participants for promotional purposes. By joining the tour, you agree that Algarve Adv Trails can use any such media for marketing and promotional activities, unless you expressly state otherwise in writing prior to the tour.

12. Personal Belongings

A tank bag to keep your personal items (wallet, phone, etc) will be provided. Algarve Adv Trails is not responsible for any loss or damage to personal belongings during the tour. It is advised that participants bring only essential items and secure them properly.

13. Jurisdiction

Any legal disputes that arise will be settled in accordance with the laws of Portugal, and any proceedings shall take place in the courts of the Algarve region.

By booking a tour or rental with Algarve Adv Trails, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
